South Dakota's age of consent is 16. There is a close-in-age exemption under South Dakota Codified Laws Section 22-22-1: sexual activity with a minor aged 10 to 15 is a lesser offense if the defendant is less than three years older.
South Dakota has no statewide sex education mandate. When districts offer sex ed, it is typically abstinence-only, reflecting the state's conservative rural character. There is no requirement for medical accuracy, no LGBTQ+ inclusion mandate, and no consent education standard. Many rural districts in South Dakota offer minimal formal sex education.
South Dakota's adult entertainment environment is restrictive. Rapid City and Sioux Falls have adult entertainment businesses regulated through local licensing, but the regulatory posture is conservative. The state's small population and strong social conservative political culture support restriction over permissiveness. Sturgis, site of the annual motorcycle rally, has a distinctive short-period adult entertainment economy during the rally week, but this is a temporary and localized phenomenon.
