Montana's age of consent is 16. There is a close-in-age exemption: sexual activity with a 12- through 15-year-old is treated as a lesser offense if the defendant is less than three years older, under Montana Code Annotated Section 45-5-502.

Montana has no statewide sex education mandate. When sex ed is offered, districts have broad discretion over content and approach.
