Montana's age of consent is 16. There is a close-in-age exemption: sexual activity with a 12- through 15-year-old is treated as a lesser offense if the defendant is less than three years older, under Montana Code Annotated Section 45-5-502.
Montana has no statewide sex education mandate. When sex ed is offered, districts have broad discretion over content and approach. The state's guidelines do not mandate abstinence-only instruction, reflecting a more libertarian-leaning political culture on education policy. Instruction that does occur is more likely to be abstinence-plus in tone, but there is no binding framework either way.
Montana's adult entertainment environment is moderate. Billings, Missoula, and Bozeman have adult entertainment businesses operating under local licensing. The state does not impose unusual state-level restrictions on adult businesses. Montana's political culture is libertarian enough on personal freedoms that there has been no sustained campaign to restrict adult entertainment.
